Canadian government increases trademark fees for 2026

The Government of Canada has mandated through legislation that certain fees related to trademark applications and registrations, geographical indications, and official marks, among others, are subject to "annual adjustment."

In other words, certain fees will go up annually. As of January 1, 2026, the affected fees are scheduled to increase by 2.7%.

Not all fees are affected. Some of the affected fees our clients are frequently called upon to pay are as follows:

Online application for a trademark

For the first class of goods or services to which the application relates

  • 2025 fee: $478.15
  • 2026 fee: $491.06

For each additional class of goods or services to which the application relates as of the filing date

  • 2025 fee: $145.12
  • 2026 fee: $149.04

Filing a statement of opposition against a pending trademark application

  • 2025 fee: $1,085.76
  • 2026 fee: $1,115.08

Application to extend an existing trademark registration

  • 2025 fee: $623.27
  • 2026 fee: $640.10

For each additional class of goods or services to which the application relates as of the filing date 

  • 2025 fee: $145.12
  • 2026 fee: $149.04

Filing a request that the Registrar of Trademarks issue a cancellation notice (s.45)

  • 2025 fee: $579.42
  • 2026 fee: $595.06

Online renewal of a trademark registration

For the first class of goods or services to which the request for renewal relates

  • 2025 fee: $579.42
  • 2026 fee: $595.06

For each additional class of goods or services to which the request for renewal relates

  • 2025 fee: $180.61
  • 2026 fee: $185.49

Although the amount of the changes is not terribly large, trademark owners with larger portfolios might now consider if steps such as renewing registrations should be completed prior to the end of 2025. Also, those contemplating new multi-class applications might consider advance filing to avoid the 2026 increase in fees.
