Judge dismisses $20 million lawsuit against City of Winnipeg

Fillmore Riley LLP represented the City of Winnipeg in a lawsuit filed by Terracon Development Ltd. which alleged that the city backed out of a deal to develop industrial land in St. Boniface. 

Terracon initiated the lawsuit in 2016, claiming that the City reneged on a joint venture to develop a vacant 237-acre parcel of City-owned land in St. Boniface and acted in a manner warranting a historically large award of punitive damages.

In a written decision, Justice Bock of the Manitoba Court of King’s Bench dismissed the claim, finding that the parties never concluded a legally binding agreement. He further held that the City did not owe Terracon a fiduciary duty and that the City did not misconduct itself in any way.
