Dayna Steinfeld published article about human rights in hiring.
Dayna Steinfeld, an associate of Fillmore Riley LLP, published an article titled, “Human Rights in Hiring: Employers must avoid discrimination during their hiring process” in the Q1 2017 edition of Piling Canada.
In the article, Dayna writes that the “minimum floor” of rights and obligations set out by human rights law are not contingent on an employment agreement; the rights and obligations are engaged from the time an employment advertisement is posted or the pre-hiring process starts.
There are, however, circumstances where differential treatment in hiring is acceptable. Dayna describes a “bona fide occupational requirement” and provides some useful questions an employer should ask that may help employers meet their human rights obligations in hiring.
