Practice Scope
Fillmore Riley assists clients in all aspects of construction-related matters, from planning and commencement to completion. This includes dispute resolution and general advice on the project structure, as well as specific advice and assistance in all aspects of contracting and subcontracting. We have extensive experience with the Builders’ Liens Act, providing advice with respect to compliance, land titles filings, and related builders’ lien litigation. The lawyers in this group assist in all construction related areas, ranging from the simplest of residential home building contracts, to the complexities of multi-million dollar mega project developments.

Contracting – From simple development agreements to complex construction, engineering, and architectural contracts. We offer all aspects of contracting services including experience and familiarity with industry standards CCA and CCDC documentation.

Planning – We offer assistance prior to commencement in constructing a project and the related legal implications of the contracting relationships.

Lien Holdbacks and Compliance – We offer our clients up front advice and assistance in respect to lien holdbacks and trust obligations under the Builders’ Liens Act of Manitoba, including maintenance of holdback accounts where required.

Builders’ Liens – We assist in the preparation and registration of liens and all related services in respect of prosecuting and defending lien claims

Construction Litigation – We have extensive experience in litigation involving disputes between various parties to a construction project including owners, architects, engineers, contractors, sub-contractors, material suppliers, as well as sureties for performance bonds, and labour and material payment bonds.
